TERMS OF SERVICE

1. Definitions.

It is specified that in this contract:

  • Imaginarium Academy: is Imaginarium Academy Ltd, trading as Imaginarium Film Academy, with registered office at C/O Pearson & Associates, Suite E Canal Wharf, Eshton Road, Gargrave, Skipton, North Yorkshire, England, BD23 3SE. Company number: 14006463.

  • H-Farm: is H-International School S.r.l., with registered office in Via Olivetti 1, 31056, Roncade (TV) C.F. P.IVA 03888620261, venue partner for the Summer Film Camp.

  • User: is the physical person benefiting from the Summer Film Camp organised by Imaginarium Academy.

  • Consumer: is the physical person who proceeds to purchase the Summer Film Camp organised by Imaginarium Academy, in the capacity of User or on behalf of the latter in the case of a minor.

  • App Summer Academy or App: this App is owned by H-International School S.r.l., and is dedicated to the H-Farm Summer Academy. It can be downloaded via the link/QR code provided in the order confirmation email.

  • Confidential Pupil Status: Families may request that their child be known by a preferred name or alternative first name during camp rather than their legal name. This protects participant privacy whilst allowing us to celebrate creative achievements. Full legal names are used only in confidential legal, medical, and financial documentation.

2. Object of the Contract.

This contract regulates the enrolment of the User in the Summer Film Camp organised by Imaginarium Academy in partnership with H-Farm ("Residential Camp"). The features of the Residential Camp are described in the illustrative material available on the website  www.imaginarium.tv. This material contains: purpose of the camp, calendar, duration in days, programme, venue, services included, enrolment procedure, costs, etc.

Imaginarium Academy reserves the right to change the dates and times of the Residential Camp due to internal organisational requirements or dependent on external provisions.

The Residential Camp takes place at H-Farm's facilities. Participants must comply with both Imaginarium Academy and H-Farm's policies whilst on site.

3. Residential Camp Prices.

The prices of the Summer Film Camp can be found on the website  www.imaginarium.tv,  in the section relating to the Residential Camp. All prices indicated are inclusive of the following activities and services:

  1. Organisation and provision of the Residential Camp and its contents.

  2. Film-making, Screen-acting, and screenwriting tuition and materials.

  3. Accommodation.

  4. Lunch and snacks.

  5. Excursions as detailed in the marketing material related to the Residential Camp.

  6. Airport transfers to and from Venice Marco Polo Airport.

4. Enrolment, Payment and Invoicing Procedures.

To enrol, it is necessary to complete the booking form with the identification and contact data of the natural or legal person who will make the payment and to whom the invoice will be addressed and the personal data of the User who will participate in the Residential Camp. The collection and processing of such data are carried out in accordance with the privacy policy provided by Imaginarium Academy in relation to the Summer Film Camp 2026.

During the booking process, the User/Consumer will be required to review and accept these "Terms and Conditions" of service provision, the Code of Conduct, and to confirm that they have read the privacy policy provided by Imaginarium Academy by giving consent to the processing of the User's sensitive data and the optional consent to receive informational and/or commercial communications.

Participant Privacy Preferences

During the booking process, the Consumer will specify preferences regarding:

  • The name by which the participant should be known during camp (legal first name, preferred name, or Confidential Pupil Status using an alternative first name)

  • Use of the participant's image and creative work in Imaginarium Academy promotional materials

  • Inclusion of the participant's name in credits and shared materials

These preferences may be updated at any time by contacting academy@imaginarium.tv. Imaginarium Academy will respond promptly to any requests regarding participant privacy. Full legal names are used only in confidential documentation including contracts, medical records, and financial records, which are stored securely in accordance with UK GDPR requirements.

To complete the enrolment request, it is necessary within 5 days from the booking date to:

A. Complete the payment of the enrolment fee by bank transfer according to the instructions contained in the booking confirmation email.

B. complete the required documents for participation (the "Submission of the Mandatory Data and Document").

The User will be required to provide additional information and documents necessary to complete the enrolment process, including sensitive data related to any medical needs, allergies, food intolerances, educational needs, or other useful information that can help make the User's stay as enjoyable as possible.

The User/Consumer must digitally sign the documents accepted during the pre-contractual registration phase to formalise the conclusion of the contract with Imaginarium Academy. A copy of these "Terms and Conditions," of the Summer Film Camp 2026 Camper Code of Conduct, the privacy policy provided by Imaginarium Academy and, in general, the contractual documentation signed by the Consumer, will be sent to the latter via email to the address provided at the time of booking.

The links to access the form and the contract will be sent via email.

The User will be able to download the Summer Academy app via the App Store or Play Store. The app will allow the User/Consumer, on a voluntary basis, to have quick access to organisational information, staff contact details, and to receive photos, projects, and final certificates of the experience.

All information regarding the processing of personal data through the aforementioned app is contained in Toddle's privacy policy, which the User/Consumer can review upon first access to the app, with the option to provide, either at that time or at later stages, consent for the optional processing of data, including those belonging to special categories as per Article 9 of Regulation (EU) 679/2016 (where applicable).

5. Enrolment Acceptance, Information and Personal Data.

The Enrolment shall be deemed to have been completed upon Payment of the enrolment fee and submission of the Mandatory Data and Document (the "Enrolment"). Once the enrolment will be completed, the Consumer will receive an official confirmation via email from Imaginarium Academy, together with a copy of the documents signed using the methods described in the preceding paragraph.

In order to guarantee the best learning conditions, camps are reserved for a limited number of participants. Enrolments are therefore accepted until all available places are filled. In the event that the Consumer wishes to enrol in a camp for which no places remain available, Imaginarium Academy will draw up a waiting list and contact the Consumer in the event of vacancies.

For the purposes outlined above, the Consumer declares and guarantees that the data and information provided to Imaginarium Academy and H-Farm through the App and in the signed contractual documents are true, accurate, and sufficient to allow for their (or the enrolled minor's) identification and the proper understanding of their needs.

The Consumer further declares and guarantees that they have the authority to upload and process, via and through the App, the personal data and any special categories of data contained in the uploaded documentation and that such data has been collected in compliance with current privacy regulations.

6. Right of Withdrawal.

Without prejudice to the right to reimbursement as regulated by art. 7 below, the Consumer has the right to withdraw from the contract signed by accepting the present "Terms and Conditions", without having to provide any reason and without having to pay any penalty, within 14 days from the Enrolment as referred to in Article 5.

The statutory 14-day cooling off period does not apply to bookings made within 60 days of the Residential Camp start date. This is because the Summer Film Camp is a service involving accommodation, catering, and leisure activities provided on specific dates, which is exempt from the cooling off period under the Consumer Contracts Regulations 2013.

The right of withdrawal may be exercised by the Consumer, within this period, by sending a written communication via email to: academy@imaginarium.tv, as specified in Article 9 below, provided it is confirmed by registered letter with return receipt, to be sent to the contact details outlined in Article 8 below within 48 hours thereafter.

The notice of withdrawal, under penalty of ineffectiveness, must contain:

  • the personal data of the Consumer and those of the User, if a different subject.

  • a copy of the booking form.

  • the bank details (IBAN code, name of the bank and agency, account holder) of the current bank account to which Imaginarium Academy will credit the paid fees, where due pursuant to art. 7 below.

The Consumer acknowledges and expressly accepts that after the term of 14 days from the date of registration, as well as following the full execution of the contract by Imaginarium Academy, it will no longer be possible to exercise the right of withdrawal.

7. Refund Rights.

In the event that the right of withdrawal is exercised by the Consumer according to the procedures and within the time limit set out in art. 6 above, Imaginarium Academy shall refund in full the sums already paid by bank transfer within 14 days from the date of receipt of the notice of withdrawal sent by the Consumer. For cancellations occurring after the 14-day cooling off period (where applicable):

  • more than 60 days before the beginning of the Residential Camp, Imaginarium Academy shall reimburse 50% of the camp fee.

  • within 60 days before the start of the Residential Camp, no refund will be made.

  • For bookings made within 60 days of the Residential Camp start date, no refund will be made at any time.

In cases of force majeure or failure to reach the minimum number of camp participants, Imaginarium Academy has the right to cancel the Residential Camp, reimbursing participants the full amount paid.

As an alternative to the right to reimbursement as regulated in the previous periods, in the event of cancellation, at the express request of the Consumer, the registration fee already paid may be transferred as credit for participation in other initiatives or converted as a voucher for the purchase of other initiatives.

Any form of further compensation in favour of the Consumer is excluded.

This is without prejudice to the possibility for the withdrawing Consumer to transfer the registration fee to another person, without further costs, upon written authorisation from Imaginarium Academy.

The User shall not be entitled to any refund of the fee paid if he/she fails to attend the Residential Camp on the scheduled date or interrupts attendance for causes and reasons not referable to Imaginarium Academy.

8. Communications.

Without prejudice to the provisions of art. 6 above, all communications and notifications relating to these Terms and Conditions must be addressed, via registered letter with return receipt, to: Imaginarium Academy Ltd, C/O Pearson & Associates, Suite E Canal Wharf, Eshton Road, Gargrave, Skipton, North Yorkshire, England, BD23 3SE or via email to academy@imaginarium.tv.

9. Assistance and Complaints.

Any requests for assistance must be forwarded via email to: academy@imaginarium.tv.

Any complaints may also be sent to the same address, specifying "COMPLAINTS" in the subject line.

If you are not satisfied with our response to your complaint, you may refer your complaint to an independent Alternative Dispute Resolution (ADR) provider. We will provide details of an appropriate ADR provider if your complaint cannot be resolved directly with us.

10. Intellectual Property Rights.

The User and the Consumer (if a different party) acknowledge and agree that Imaginarium Academy and H-Farm are and will remain the sole and exclusive owners of all logos, trademarks, and distinctive signs present on the App and associated with Imaginarium Academy and/or H-Farm and/or the companies of the H-Farm S.p.A. group, of which H-Farm is a part, as well as owner of all intellectual property rights of whatever kind and nature existing on and/or relating to them. The User and the Consumer (if a different party) therefore agree not to remove or attempt to remove any copyright-protected elements, trademarks, or other distinctive signs of Imaginarium Academy, H-Farm or its suppliers displayed on the App interface

Without prior written authorisation from Imaginarium Academy or H-Farm, no document, file, hyperlink, image, photograph, video, or any other graphic element may be reproduced, copied, or stored, in whole or in part, on other servers, published through other digital communication channels and/or online services, or copied or archived on electronic devices, such as, but not limited to, USB drives, CD-ROMs, or other data storage devices.

Should the User and the Consumer (if a different subject) encounter or become aware, in any way, of the source code, object code, and/or operational algorithms of the App during its use, they:

a. Shall not directly or indirectly (e.g., through third-party activities or those of other users):

I. Circumvent or attempt to circumvent the technical protection measures and technical restrictions implemented on the App and/or its software to identify codes and/or algorithms of any kind or nature (e.g., source and object codes);

II. Analyse, decrypt, decompile, disassemble, and/or perform reverse engineering on the App and/or its software or attempt to carry out such activities;

III. Alter, modify, and/or manipulate in any way the App's functionality and/or its software;

IV. Extract, copy, duplicate, store, and/or collect, directly or indirectly, manually or using specialised software, any data, information, code, and/or algorithm of any kind or nature used by or for the App's operation, its software, and/or otherwise uploaded and contained within the App (so-called "data scraping").

b. Consequently, they may not use the services, access the App, or use its software in any way that allows for the reproduction, creation of elaborations or derivative works, or distribution to third parties of copies of materials covered by Imaginarium Academy or H-Farm intellectual property rights.

11. Limitations of Liability.

The User (and/or the Consumer on their behalf, in the case of a minor) declares and guarantees to be the sole and exclusive user of the App, committing to keeping their login credentials strictly confidential.

The User (and/or the Consumer on their behalf, in the case of a minor) acknowledges and accepts that the services provided through the App are "as is" and based on constantly evolving technologies. As a result, the technical features of the App may be modified as necessary due to technological advancements or supply and/or organisational needs.

The User (and/or the Consumer on their behalf, in the case of a minor) acknowledges that the internet, necessary for using the App, is not controlled by Imaginarium Academy or H-Farm and, due to the peculiar structure of the network, no public or private entity, including Imaginarium Academy or H-Farm, can guarantee or monitor the performance and functionality of the network's branches or control the content of information transmitted through it. Consequently, no related liability can be charged to Imaginarium Academy or H-Farm.

Imaginarium Academy maintains appropriate public liability and professional indemnity insurance for the delivery of the Summer Film Camp programme and activities. H-Farm maintains insurance for their venue and facilities.

As stated and guaranteed in the section "Acceptance of Enrolments. Information and Personal Data" above, the User (and/or the Consumer on their behalf, in the case of a minor) indemnifies and holds Imaginarium Academy and H-Farm harmless from any direct and/or indirect damage arising from the upload of information, data, and documentation on the App, as well as from any liability for any direct and/or indirect damage that may arise in the hands of Imaginarium Academy or H-Farm due to violations by the User (and/or the Consumer on their behalf, in the case of a minor) of applicable privacy regulations regarding the personal data, including special categories of data, uploaded, entered, saved, and processed on the App.

Imaginarium Academy and H-Farm shall not, at any time or in any way, be held responsible for the content of third-party web pages that can be accessed via hyperlinks present and/or linked from the App.

12. Processing of personal data.

The processing of personal data will be carried out by Imaginarium Academy in compliance with the provisions of UK GDPR and by H-Farm in compliance with EU Regulation 2016/679 on the protection of individuals with regard to the processing of personal data (the "GDPR"). The types of data processed, the methods of processing and the purposes thereof, as well as of the data subject, are detailed in the Privacy Policy available in the notice on personal data processing provided by Imaginarium Academy and H-Farm in relation to the Summer Film Camp 2026.

13. Exclusive jurisdiction and applicable law.

This contract is governed by the laws of England and Wales.

Any dispute inherent to, subsequent to or in any way connected with this contract and its execution, termination or invalidity shall be the exclusive jurisdiction of the courts of England and Wales.

For matters relating specifically to H-Farm's facilities and services, Italian law and the jurisdiction of the Court of Treviso may apply as set out in H-Farm's terms.

14. Express approval.

The Consumer declares to have expressly reviewed/read and approved the following provisions: Article 3 - Residential Camp Prices, Article 4 - Enrolment, Payment and Invoicing; Article 5 - Acceptance of enrolments; Article 6 - Right of withdrawal; Article 7 - Right of refund; Article 11 - Limitation of Liability; Article 13 - Exclusive jurisdiction and applicable law.

By enrolling in Imaginarium Film Academy Summer Camp, participants and parents/guardians acknowledge that they have read, understood, and agree to abide by this these Terms of Service.
